The same problems occur whenever we get a fantastic idea for an invention in any field: How do we
patent an idea? What is the procedure for obtaining a patent for a product? How can you tell if your innovation has been patented or registered? In this essay, we'll go through the fundamental concepts you should be aware of to secure your ideas.

What is the definition of an invention?

You should know that an invention is that new solution to a technical problem, new or old, that has not been thought of before by anyone, and if not, that has not been published. This must have an idea of practical application. Click here for more information InventHelp

How to patent an idea?

According to the Patent and Trademark Office (OEPM), a patent is "a title that recognizes the right to exclusively exploit an innovation by prohibiting others from creating, selling, or using it without the owner's permission."The patent an invention is made available to the public for general knowledge in exchange." In this view, we must recognize that they are the only valid means of demonstrating ownership of an industrial application idea or concept. Patents are property titles, allowing the inventor to conduct negotiations based on the entire or partial session of the exploitation rights of the concept protected by the patent.

There are two types of applications with which you can protect your ideas: Patents and utility models. Next, we will tell you what their fundamental differences are:

Patent:

This can protect a new procedure, a new device, a new product, or an improvement or improvement thereof. Its procedure includes the completion of a review report on current patents registered in the world called: the State of the Art Report.

Patents grant protection for 20 years and the first year of international protection can be extended for an additional 18 months through a PCT application.

Utility Model:

Although the requirements that are requested are similar to those of patents, it can be said that they are less strict. Utility models are used to protect inventions of less inventive degree. Utility models are seen as particularly suited to SMEs making 'minor' improvements to existing products. The procedure for the Utility Model is fast and does not include the preparation of a State of the Art Report.

Utility Models grant protection for 10 years and the first year of international protection can be extended for another 18 months through a PCT application.

In practical terms, Utility models will be treated as patents when filing an international patent application (PCT).

Can I patent a mobile application?

Mobile applications (APP) are computer programs that can include creations of another nature such as illustrations, sound, and in many cases a brand or trade name.

These creations must be protected in different ways to achieve comprehensive protection. As far as the source code is concerned, it is protected by copyright.

What are the types of inventions that are covered by a patent?

A patent grants protection to all those product or procedure inventions that, being new and the result of human ingenuity, have industrial application and solve a technical problem. Said inventions may belong to any of the following technical areas:

Life Sciences

It is one of the most complex technical areas of patent law due to the frequent changes in patentability standards. It covers from new pharmacological compounds to medical devices, but not diagnostic methods or surgical or therapeutic treatment performed on the human or animal body.

Electricity and Electronics

It encompasses inventions in electronic components, semiconductors, refrigeration systems, electromagnetic measurement devices, nuclear radiation detectors, and even thermoelectric systems.

Energy and Environment

It includes everything from inventions related to fossil energy sources, such as improved hydrocarbon transport systems, to innovations in the field of renewable energies, such as photovoltaic panels with improved performance or new catalysts for fuel cells.

Civil Engineering

Innovations in this field often arise from the need to improve products or processes to reduce labor costs, increase energy efficiency, improve safety and/or ensure environmental sustainability.

Chemistry, Materials Engineering, and Nanotechnology

It covers inventions on advanced composite materials, nanomaterials, catalysts, biomaterials, graphene, methods, and devices for the extraction and processing of hydrocarbons, development of industrial chemicals, etc.

Food Technology

Within this field, it is possible to protect new food and beverage production processes, improved preservation methods, healthy foods, improved flavors, as well as the packaging procedures for these products and their packaging.

Information technology and software (“computer-implemented inventions”)

It is one of the most developed technical areas today. It covers technologies such as cybersecurity, cryptography, Blockchain, electronic certification, secure payment methods, augmented reality systems, robotics, Internet of Things (IoT), simulations, and artificial intelligence (AI). Why is it important to know how to patent an idea?

Because it will save you problems and you will be able to follow the necessary procedures to protect it. You will also be able to present your idea to investors, possible partners, or clients through the market strategies that you consider necessary without fear of the idea being stolen. It is also how you can be recognized as its rightful owner. To exploit it, to modify it, or for whatever you want or need. And to prevent or dissuade third parties from making illegitimate or illegal use of your idea, whether for profit or not. In the same way, you will have exclusivity in its use and commercialization. Otherwise, you will not be able to exploit it commercially for profit. It is your idea and the benefits it generates should be yours.
